Lexmark doesn't take to kindly to anyone else filling their ink cartridges. Luckily that proprietary lawsuit got turned over. The debate actually involved the resetting of the computer counter chip on their cartridges than the actual refilling of them. Obviously because Lexmark ink cartridges do not and will not print when the counter hits zero - the chip will have to be reset.
Similar to Epson catridges, Lexmark cartridges have a counter chip that gauges the amount of ink left in the cartridge as well. The only difference is that when the cartridge hits zero the only way to reset the chip is to have Lexmark do it. The ink refilling businesses and printer stores can't do it - and the ones who did got slapped with a lawsuit by Lexmark.
Obviously it's going to be alot smarter to send your Lexmark printer cartridge back to Lexmark to have them refill and reset the cartridge than it would be to buy a new cartridge from the store. Again, you will be saving alot of money going this route, but it depends on how quickly you need your ink. Lexmark also offers a rebate for refilling your ink cartridges.
